Terms of Service
Welcome to StepChique. These Terms of Service ("Terms") are a legal agreement between you and StepChique LLC ("StepChique," "we," "us," or "our") and govern your access to and use of the StepChique mobile app, website, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement of a parent or guardian. By using the Service, you represent that you meet these requirements and that the information you provide is accurate.
2. Your Account
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- You agree to provide accurate information and to keep it up to date.
- Notify us promptly of any unauthorized use of your account.
- Guest access (for example, via a venue QR code) is provided for convenience and may be temporary or limited in functionality.
3. Acceptable Use
You agree not to:
- Violate any law or the rights of others, including intellectual property rights;
- Post content that is unlawful, harassing, hateful, defamatory, obscene, or infringing;
- Impersonate any person or misrepresent your affiliation with a venue, instructor, or organization;
- Submit false, spam, or abusive song or dance requests, or manipulate voting;
- Interfere with, disrupt, probe, or attempt to gain unauthorized access to the Service or its systems;
- Scrape, reverse engineer, or use automated means to access the Service except as expressly permitted.
4. User Content
The Service lets you post content such as profile information, playlists, posts, comments, ratings, and song or dance requests ("User Content"). You retain ownership of your User Content. By posting it, you grant StepChique a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content solely for the purpose of operating, improving, and promoting the Service. You are responsible for your User Content and represent that you have the rights necessary to post it. We may remove content that violates these Terms.
5. Venues, Instructors, and DJ Features
The Service connects dancers with venues, instructors, and events. StepChique does not own, operate, or control the venues or events listed and is not responsible for what occurs at them. Venue listings, request sessions, now-playing information, and event details are provided by venue operators, DJs, or other users, and StepChique does not guarantee their accuracy or availability. Submitting a song or dance request does not guarantee it will be played.
6. Events, Tickets, and Payments
- Ticketed events may be created by venues or organizers. Purchases are processed by our payment processor, Stripe, and are subject to Stripe's terms.
- Prices, availability, and refund or cancellation policies for an event are set by the applicable venue or organizer. Contact the organizer for refund requests unless otherwise stated.
- StepChique is not the seller of event tickets and is not responsible for an event being canceled, rescheduled, or not as described.
7. Third-Party Services
The Service integrates with third parties including Spotify, CopperKnob, Stripe, Google, and Sentry. Your use of those features may be subject to the third party's own terms and privacy policies. StepChique is not responsible for third-party services and does not endorse their content. Music playback features depend on Spotify and your own valid Spotify account and subscription where required.
8. Intellectual Property
The Service, including its software, design, text, graphics, the "StepChique" name and logo, and all related intellectual property, is owned by StepChique LLC or its licensors and is protected by copyright, trademark, and other laws. Except for your User Content and the limited rights expressly granted here, nothing in these Terms transfers any rights to you. You may not use our name, logo, or branding without our prior written permission.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the fullest extent permitted by law, StepChique LLC and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or fifty U.S. dollars ($50).
11. Indemnification
You agree to indemnify and hold harmless StepChique LLC and its owners and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, or your violation of these Terms or the rights of others.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
13. Governing Law
These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Dane County, Wisconsin, and you consent to their jurisdiction.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the date at the top of this page and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
